Terms and conditions

These terms apply to quotations and jobs from Aannemer Maarssen for private clients in our own working area. If a signed quotation (offerte) or order confirmation says something different from this page, what it says applies.

This English text exists so you can read what you are agreeing to. The Dutch version is the binding one, because the contract you sign is drawn up in Dutch and Dutch law applies to it. Where the two differ, the Dutch text decides, and we would rather point that out here than leave you to discover it.

A quotation is valid for thirty days and contains a fixed price for the work as described, including Dutch VAT (btw). The quotation also states what is explicitly not included. Items you choose yourself, such as tiles or sanitary ware, are listed as a provisional sum (stelpost) and settled afterwards against the actual cost, with no mark-up.

A survey at your house and the quotation that follows from it are free and without obligation.

Meerwerk is work outside the signed contract. It arises through a change at your request, through something that only becomes visible after demolition, or through a requirement set by the municipality or the structural engineer (constructeur). In all three cases the same route applies: work on that element stops, you receive a price within two working days with the effect on the planning, and it is only carried out after your written approval. Meerwerk is added to the next instalment.

An arithmetic error in our own quotation, extra hours caused by our planning, removal of building waste, protection of existing floors and repair of damage we cause are never meerwerk.

Nothing is paid in advance before work starts. The contract sum (aanneemsom) is paid in four instalments: 30 per cent on the day work starts on site, 30 per cent once the shell is complete and the work is wind and watertight, 30 per cent once the services have been tested and the fit-out is complete, and the last 10 per cent after handover (oplevering), once every snagging point has been cleared.

The cost of drawings, the structural calculation and the permit sits outside these four instalments and is named separately on the quotation. Invoices are payable within fourteen days.

The start date is fixed in writing once the preparation is complete. You receive the plan for the coming week every Friday. If the work overruns, you hear as soon as we know, with a new date, and not at the end of the original planning.

Frost, persistent rain and lead times outside our control can move the planning. That moves the date, not the price.

At handover we walk the work through together and note everything you point out on a single list. Those points are cleared within fifteen working days. The final instalment of 10 per cent is only invoiced once every point on that list has been signed off.

For twelve months after handover you can call about the work carried out and we come and look. That is a commitment on top of the rights you already have under Dutch law; those statutory rights are not limited by it.

You can cancel the job as long as work has not started on site. You then pay for what has actually been produced or ordered at that moment: drawings, structural calculation, permit fees, and materials with long lead times that have already been ordered. Those amounts are stated on the quotation in advance, so you know the maximum risk before you begin.
